Terms of carriage

These terms govern every shipment Atlas Logistics Corp accepts. Handing us a parcel means you accept them, whether or not you signed a separate contract.

1. Who these terms bind

“We”, “us” and “Atlas” mean Atlas Logistics Corp, a licensed freight forwarder and customs broker registered in New South Wales under US DOT 3184920 · MC 1129476. “You” means the shipper named on the waybill, and anyone else with a legal interest in the goods — including the consignee and any owner who is not the shipper.

The waybill is the contract. If a term in your own purchase order conflicts with these terms, these terms govern unless we have signed something that says otherwise.

2. What we will carry

We accept general cargo, commercial goods, documents and personal effects, subject to the prohibited and restricted items list. We may open and inspect any shipment at any time, without notice, and we are required to do so when a regulator or customs authority asks.

3. Your obligations as shipper

  • Describe the contents accurately and completely on the waybill and the commercial invoice.
  • Pack goods so they survive normal handling, including sorting-belt drops and stacking.
  • Declare anything hazardous, temperature-sensitive, fragile or of unusual value before collection.
  • Hold the necessary export and import permits and pay any duties and taxes that fall due.
  • Ensure your shipment does not breach Australian sanctions or export control law.

Misdeclaration is the single most common cause of loss. If a shipment is described inaccurately and is then seized, delayed or damaged as a result, our liability is excluded entirely and you remain responsible for any fine or storage cost we incur.

4. Transit times

Delivery estimates shown on your tracking page and in quotations are estimates, not guarantees. They assume customs clears without a hold, the destination is accessible, and no event under clause 8 intervenes.

Where you have purchased a service we describe in writing as time-definite, and we miss the committed window for a reason within our control, the remedy is a refund of the freight charge for that shipment. That refund is the whole remedy; it does not extend to consequential loss.

5. Charges

Freight is charged on the greater of actual weight and volumetric weight, calculated at 1 kg per 5,000 cm³ . We reweigh and remeasure on arrival at the first hub and will adjust the invoice where our figures differ from yours.

Duties, taxes, storage, demurrage, re-delivery attempts, address corrections and remote-area surcharges are additional. Where we advance duties and taxes on your behalf, an advancement fee applies and the sum is repayable on demand.

Invoices are due 14 days from the date of issue. Overdue amounts carry interest at 1.5% per month or the maximum permitted under Australian law, whichever is lower.

We are not liable in any circumstance for loss of profit, loss of market, loss of contract, or any other indirect or consequential loss, even where we were told such loss was possible.

7. Claims

Notify us of visible damage at the point of delivery and note it on the delivery record. For concealed damage or partial loss, write to support@atlaslogisticscorp.com within 14 days of delivery. For total loss, within 30 days of the date the shipment should have been delivered.

Keep the packaging and the goods available for inspection until the claim is settled. Claims are not considered while any invoice on the account is overdue.

8. Events outside our control

We are not liable for delay or loss caused by events we cannot reasonably control: weather, natural disaster, war, civil unrest, strike or labour dispute, epidemic, air or road closure, cyber incident, regulatory action, or an act or omission by you, the consignee, or a customs authority.

9. Undeliverable shipments

Where a shipment cannot be delivered, we attempt contact for 10 business days, then return it to the shipper at the shipper’s cost. Where return is impossible or is refused, we may dispose of the goods after 30 days and apply the proceeds against sums owed to us.

10. Governing law

These terms are governed by the laws of New South Wales, Australia and, where applicable to international carriage, by the Montreal Convention 1999 and the Carriage of Goods by Sea Act 1991 (Cth). Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
